Abstract

Objective: this research examines the implementation of identity protection for children in conflict with the law under Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA) at the Semarang Police Department (Polrestabes Semarang), with a focus on the right to not have their identity published as stated in Article 19 of the UU SPPA.

Methodology/Approach/Design: this study adopts a socio-legal approach by collecting data through non-partisan observation, in-depth interviews, and literature review. The data analysis process includes data reduction, data presentation, and drawing conclusions regarding the implementation of identity protection for children at Polrestabes Semarang.

Results and Discussion: the findings reveal that the implementation of identity protection for children in conflict with the law at Polrestabes Semarang has not yet been optimal and effective. However, various efforts have been made by the Women and Children Protection Unit of Polrestabes Semarang.

Practical Implications: this research has practical implications for evaluating law enforcement, particularly within the context of the juvenile criminal justice system. It provides a space for reflection for the police, media, and courts to pay closer attention to the interests and the right of children in conflict with the law to not have their identity published. This study also highlights the need for legal system reform and adjustments that are more detailed and child-friendly.

Novelty/Value: This study offers novelty by identifying and evaluating the implementation of identity protection for children in conflict with the law, specifically at Polrestabes Semarang, through a socio-legal approach, making this research more comprehensive.
