There is regulation regarding prohibition to recruit contract-based employees to fulfill lack of public servants position in government institutions. Hence, discretion cannot be used to comply manpower need, but still can be done through formation proposal of public servants and/or contract-based employees. Contract-based employees still have to conduct their job for maximum 5 years and have opportunity to be recruited as non-organic employees (non-organic public servants) as long as the employees comply conditions stated in Government Regulation Number 49 of 2019. Keywords: Discretion of Government Officers, Non-Organic Public Servants Abstrak Penelitian ini dilakukan untuk mengetahui akibat hukum yang timbul dari diskresi Pejabat Pemerintahan dalam perekrutan pegawai tidak tetap/non-PNS (honorer/kontrak) setelah berlakunya PP Nomor 49 Tahun 2018 tentang Manajemen PPPK. Metode pendekatan yang digunakan adalah yuridis normatif, spesifikasi penelitian yang digunakan adalah deskriptif analitis. Terdapat ketentuan tentang larangan perekrutan Pegawai tidak tetap/non-PNS untuk mengisi jabatan ASN di instansi pemerintahan. Oleh karena itu diskresi tidak dapat lagi digunakan untuk memenuhi kebutuhan pegawai, namun dapat dilakukan melalui usul formasi CPNS dan/atau PPPK. Pegawai tidak tetap/non-PNS masih tetap melaksanakan tugas paling lama 5 (lima) tahun dan dapat diangkat menjadi PPPK apabila memenuhi persyaratan yang diatur dalam PP Nomor 49 Tahun 2018.
