Tinjauan Hukum tentang Pembimbing Kemasyarakatan dalam Sistem Peradilan Anak di Indonesia

Abstract

Objective: This research aims to understand the role of social workers (Pembimbing Kemasyarakatan) in the juvenile criminal justice system and identify the challenges they face in assisting children in conflict with the law during the criminal justice process.

Methodology/Approach/Design: This study adopts a normative legal research method. Data collection was conducted through a literature review and statutory approach. The data analysis technique is deductive, which involves drawing conclusions from general legal concepts to address specific issues.

Results and Discussion: The findings show that the role of social workers is crucial in assisting children in conflict with the law during the judicial process. This role is carried out through three stages: the pre-adjudication stage, the adjudication stage, and the post-adjudication stage.

Practical Implications: The practical implication of this research is the need for evaluation at the practical level, particularly for social workers in assisting children. Through this research, the role of social workers can undergo improvements to achieve justice and legal certainty within the juvenile criminal justice system.

Novelty/Value: This research identifies the challenges social workers face in assisting children in conflict with the law, including limited opportunities to express opinions in court, lack of coordination among law enforcement officials, and limited human resources.
