This situation has generated debate regarding the compatibility of TCEs with the fundamental principles of security law, particularly concerning ownership, economic valuation, and enforcement. This study aims to analyze the legal status of TCEs as objects of fiduciary security based on the theory of security law and to examine the legal issues arising from their implementation. This research employs a normative legal research method using statutory and conceptual approaches, with data analyzed descriptively and analytically. The findings reveal that copyright over TCEs does not satisfy the legal requirements of an object of fiduciary security because it lacks the proprietary element of eigendom, constitutes res extra commercium, and has the potential to conflict with public order (openbare orde) in the event of enforcement through public auction. Furthermore, the implementation of TCEs as fiduciary security encounters legal obstacles concerning the legal subject, as TCEs are communal intellectual property administered by the state, as well as the legal object due to the absence of financial valuation standards established by the Indonesian Society of Appraisers (MAPPI). This study contributes to the development of legal doctrine by emphasizing that the protection and utilization of TCEs within the fiduciary security framework require a dedicated sui generis regulatory regime to ensure legal certainty while preserving the communal nature of TCEs. }, issn = {2655-1942}, pages = {198--215} doi = {10.14710/ldjr.9.2026.198-215}, url = {https://ejournal2.undip.ac.id/index.php/lj/article/view/32035} }
