Abstract
Patent enforcement is a critical element in ensuring legal certainty, enhancing innovation, and strengthening a technology-based investment climate. However, patent enforcement practices in Indonesia continue to face significant structural and institutional challenges. This article identifies three principal issues: the limited institutional capacity of the Directorate General of Intellectual Property (DGIP), prolonged patent dispute resolution processes, and the lack of adequate technical expertise within judicial proceedings. This study aims to analyze the challenges of patent law enforcement in Indonesia through a comparative legal approach with Malaysia, Singapore, and Germany. The research employs a normative legal methodology with a comparative approach, relying on doctrinal analysis of statutory regulations, judicial decisions, and relevant academic literature. The findings reveal that Malaysia has enhanced patent quality through a post-grant opposition mechanism that functions as an administrative filter against weak patents. Singapore demonstrates best practices by integrating technical assistants who actively support judges in understanding the technological complexities of patent disputes. Germany, meanwhile, represents an ideal model of patent enforcement through its bifurcated litigation system and the presence of a highly specialized Federal Patent Court. This article concludes that improving the effectiveness of patent law enforcement in Indonesia requires more profound and targeted institutional reforms. Such reforms include strengthening the role of the DGIP, adopting a post-grant administrative opposition mechanism, and systematically integrating technical expertise into the judicial system. Policy recommendations are directed toward establishing a specialized patent judiciary division as a strategic step to enhance legal certainty and national innovation competitiveness
